The terms and conditions mentioned in this contract along with the Privacy Policy constitute the entire contract between the User (as defined below) and Easy Build (as defined below) with respect to access to and use of the website and the Products and Services offered by Easy Build, superseding any prior written or oral contracts in relation to the same subject matter herein.

General Terms

• You must be at least 18 years old to use our website.
• You may not use our website for any illegal or unauthorized purpose.
• You are responsible for maintaining the confidentiality of your account information and for restricting access to your computer, mobile to prevent unauthorized access to your account.   
• You agree to accept responsibility for all activities that occur under your account or password.   

Product Orders and Payment

• We reserve the right to refuse any order you place with us.
• Prices for our products are listed on the website. We reserve the right to change prices without notice.
• We will ship your order to the address you provide during checkout.
• You are responsible for all shipping and handling charges.
• We accept payments as listed on the check out page.

Pricing and Payment

• Product Prices: Prices listed are ex-warehouse/ex-store, excluding freight charges.
• Freight Charges: You will be responsible for additional freight charges associated with your order.
• Unloading: Unloading of stock at your location is not included in the base price. For selected product categories, unloading may be offered as an additional service with a separate charge. We will communicate this information clearly at the time of purchase.
• Delivery: Products will be delivered according to the terms specified in your order confirmation.
• Taxes: Applicable taxes will be added to your order based on current Indian laws.
• Payment Terms: All products are typically sold on a cash basis. Easy Build may offer credit to certain customers subject to approval and prevailing credit terms.
• Returns: Refer to our Return Policy for information on product returns.
• Product Use: Please follow the manufacturer's technical instructions and safety manual before using any product.
• Warranty: Easy Build is not responsible for claims or liabilities arising from warranty breaches or misuse of products due to non-adherence to the manufacturer's instructions.
• Risk and Title Transfer: Ownership and risk of loss for the products transfer to you upon: 
  • Full payment of the purchase price to Easy Build.
  • The departure of the transport vehicle from Easy Build’s supplier warehouse, whichever occurs later.
• Force Majeure: Easy Build will not be liable for any delays or failures in performance due to circumstances beyond its reasonable control (e.g., natural disasters, pandemic, lockdown).

Definitions

"Applicable Law" shall mean any statute, law, regulation, ordinance, rule, judgment, order, decree, by-law, approval from the concerned authority, government resolution, order, directive, guideline, policy, requirement, or other governmental restriction or any similar form of decision of, or determination by, or any interpretation or adjudication having the force of law of any of the foregoing, by any concerned authority having jurisdiction over the matter in question;

"Service" shall mean technology platform provided by Easy Build that allows Easy Build’s suppliers and service providers to offer a differentiated, hassle-free buying experience to eligible Users including a tab offered by the sellers to the Users;

"Products" shall mean goods and /or services offered by or through the suppliers as per agreed terms with Easy Build;

Supplier means various brands who are manufacturing or marketing under different brand name and including its authorised distributors, dealers, retailers and third-party manufacturer.

"User" shall mean any individual or entity as approved by Easy Build;

Consent to Accept Terms

By clicking on "Add to Cart," "Order Now," or any other tab, button or checkbox, you:

1. Confirm that you are legally authorized to enter into a contract with Easy Build according to applicable laws.
2. Agree to conduct transactions and abide by the terms and conditions outlined in this Agreement and the accompanying Privacy Policy, both of which are accessible on our website.

Easy Build is an online marketplace with its website www.easybuild.com, and mobile app that helps you to chose various products being offered by multiple brands We offer a platform for you to:

• Browse and choose products from different brands that Easy Build partners with.
• Enjoy a smooth buying experience where Easy Build helps facilitate the transaction and ensures the products are picked up from different supplier locations and are delivered to you.

Important to Note:

• Easy Build doesn't manufacture the products themselves. They simply act as a facilitator to connect with various brands and helps to provide options under one roof.
• The availability of products depends on the suppliers themselves.
• Easy Build has the right to change the services, product listings, or even stop offering them altogether, without any prior notice.

Easy Build shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the User arising out of the use Products offered by Brand/manufacturer/marketer or due to the failure of Brand/manufacturer/marketer to provide Product to the Users for any reason whatsoever including but not limited to the User's non­compliance with the Service’s terms, malfunction, partial or total failure of any network terminal, data processing system, computer telecom transmission or telecommunications system or other circumstances whether or not beyond the control of Easy Build or any person or any organization involved in the above mentioned systems.

Easy Build will not be liable for any damages of any kind arising from the use of the Products offered by the Brand/manufacturer/marketer including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Easy Build shall not be liable for any Content that you may find indecent, offensive or objectionable. You shall use the Services at your own risk.

‍Brand/manufacturer/marketer will take all reasonable measures to ensure that Merchant should fulfill his duty properly but there may be exceptions and therefore Easy Build will not be held liable for any such compensation on account of the product/brand/manufacturer/marketer not meeting expectations of Users.

Easy Build shall not be liable for any conduct of the Brand/manufacturer/marketer. Easy Build encourages Users to notify any complaints that User may have against any Brand/manufacturer/marketer that User may have.

No advice or information, whether oral or written, obtained by you from Easy Build or through or from the services shall create any warranty not expressly stated in the terms.

Easy Build disclaims any and all liability in respect of the Merchant and their Products provided thereof.

User agrees to indemnify and keep Easy Build, its affiliates and licensors indemnified against all costs, expenses, damages, losses and liabilities incurred or suffered by Easy Build or its affiliated companies related to any User content posted or transmitted by User during the use of the Website or Service or any unauthorised use of the Website or Service in contravention of this Agreement.

Review, Update or Delete your Data

In some cases, you may have the right to seek access to, amend, or delete the personal information we collect from you, depending on the laws in your country. What are your Data Protection Rights

We would like to ensure that you are fully aware of your data protection rights. Every user is entitled to the following:

• The right to access the copies of your Personal Data with us. We may charge you a small fee for this.
• The right to rectification of your information or data you believe is incorrect, by submitting adequate proofs.
• The right to erasure of your Personal Data, under certain conditions and terms of the Company.

Data Security Practices and standards

• Data Classification is done as confidential, internal and public and this helps in segregation of data access.
• Data usage policy is defined which specifies access types, conditions for data access based on classification, who has access to data, what constitutes correct usage of data, and so on. All policy violations have clear consequences. As indicated in section 6.4 of the Employment letter.
• Data usage policy is also defined for Contract workers and independent contractors which specifies access types, conditions for data access based on classification, who has access to data, what constitutes correct usage of data, and so on. All policy violations have clear consequences.
• Data and services are stored either in a private repository or under a VPN with restricted access to appropriate personnel only and no data is transferred outside the organization or the country for any reason in any case of transfer necessity appropriate permissions would be obtained for the same.
• Access control to sensitive data has been clearly defined. This restricts access to information based on the principle of least privilege: Users have to get only those privileges that are essential to perform their intended function. This ensures that only appropriate personnel can access data.
• Monitoring the sensitive data, Unusual behaviour patterns among privileged accounts is monitored along with Login failures or "access denied" events on sensitive storage or databases.
• Data retention policy is set to have data for past 10 years with process for backing up the data an regular basis with specific retention policy and to delete data once it is no longer required.
• Authentication layers with appropriate roles and permission have been implemented at different layers like Mobile Application, WebSite Portal, Database, AWS cloud etc.
• Change management and database auditing, all database activities are logged. Login activities are maintained for at least one year.

Governing law & dispute resolution

These User Terms shall be governed by, and construed in accordance with, the laws of India, without reference to principles of conflicts of law. The parties agree that the courts of New Delhi shall have exclusive jurisdiction over any dispute arising from or relating to the User Terms and/or the Website.

You expressly consent to the personal jurisdiction of said courts and waive any objection to such personal jurisdiction based on forums non convenience or any other basis.
